Summary

  • The info pack costs £49. It is digital content that you can start using straight away.
  • When you buy, you ask for immediate access and acknowledge that you lose your 14-day right to cancel once access starts. Your rights if the content is faulty are not affected.
  • Leads are priced individually and sold to one customer only. We replace or refund a lead in the situations set out in section 9, such as contact details that turn out to be invalid within 7 days.
  • Nothing in these terms affects your statutory rights.

1. Who we are and what these terms cover

These terms apply when you buy from [to be confirmed], trading as Accord Data Partners (ADP) (“ADP”, “we”, “us” or “our”). They cover the info pack and leads, and they apply alongside our website terms. If you buy leads, our lead terms also apply.

  • Company name: [to be confirmed]
  • Trading name: Accord Data Partners (ADP)
  • Company number: [to be confirmed]
  • Registered office: [to be confirmed]
  • ICO registration number: [to be confirmed]
  • VAT number: [to be confirmed]
  • Email: [to be confirmed]

2. Consumers and business customers

You are a consumer if you are an individual buying wholly or mainly for purposes outside your trade, business, craft or profession. If you are an individual buying the info pack, we treat you as a consumer unless you tell us that you are buying for an existing business. Leads are sold for business use only.

3. The info pack

  • What you get: an online course with practical modules, scripts, templates and a knowledge check, available in your ADP account.
  • Price: £49, in pounds sterling. If we are registered for VAT, the price includes VAT and your receipt shows it. The price shown at checkout is the total you pay; there are no hidden charges.
  • Access: starts as soon as your payment is confirmed. It continues while your account is open and we offer the info pack. If we ever stop offering it, we will give you at least 30 days’ notice.
  • Updates: buyer programmes and rules change, so we update the content. You will always see the current version.
  • Licence: the info pack is for your own use, as our website terms explain. Please don’t share or resell it.

4. Ordering and payment

  • You order through your account. Before you pay, you accept these terms and the version you accepted is recorded with your order.
  • Card and other methods: through Stripe’s hosted checkout. We never see your full card number.
  • Bank transfer: where we offer it at checkout, we give you our bank details and a payment reference. Your order stays “awaiting payment” until we have confirmed that the money has reached us.
  • The contract is formed when we confirm your payment. We confirm your order by email, including any request you made for immediate access.
  • If we make an obvious pricing error, we will tell you before giving access, and you can choose to pay the correct price or cancel for a full refund.

5. Your right to cancel and immediate access

Consumers normally have 14 days to cancel an online purchase. For digital content that isn’t supplied on a physical medium, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say this right ends once supply begins, if you have expressly asked for it to begin during the cancellation period and acknowledged that you will lose the right.

So at checkout we ask you to:

  1. ask for immediate access to the info pack; and
  2. acknowledge that you lose your right to cancel once access starts.

We record when you did this and confirm it in your order confirmation.

  • If access hasn’t started yet, for example while we check a bank transfer, you can cancel for a full refund by messaging us or emailing [to be confirmed].
  • Once access has started, you can’t cancel just because you have changed your mind. Your rights if the content is faulty (section 6) still apply.

6. If the info pack is faulty

Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If it isn’t:

  • you can ask us to repair or replace it;
  • if we can’t, or we don’t do so within a reasonable time and without significant inconvenience to you, you can ask for a price reduction, which can be up to a full refund;
  • if digital content we supplied damages your device or other digital content because we didn’t use reasonable care and skill, we will repair the damage or compensate you.

Tell us what is wrong at [to be confirmed] or through a portal message, and we will reply within 5 working days. Buyer programmes change: we keep the info pack updated, but a buyer changing its own terms after we described them doesn’t on its own make the info pack faulty.

7. Goodwill refunds

We may offer a refund in other circumstances at our discretion. Doing so once doesn’t create a right to a refund in other cases.

8. Leads

  • Who can buy: customers with info pack access who have accepted our lead terms.
  • Price: shown on each listing, in pounds sterling. VAT is handled as described in section 3.
  • Reservation: when you start a checkout, we reserve the lead for you for a short time (currently 30 minutes) so that nobody else can buy it while you pay. If payment isn’t completed, the lead returns to the marketplace.
  • Payment: by the methods in section 4. Contact details unlock only once your payment is confirmed.
  • Exclusive: each lead is sold once, to one customer. Once sold, it is removed from the marketplace.
  • Business purchases: leads are sold for business use, so the 14-day consumer cancellation right doesn’t apply.
  • What you are buying: an introduction to a business contact who asked to be introduced and agreed to have their details passed to one ADP customer. It is not a promise that the business qualifies for any programme, will go ahead, or that any reward will be paid.

9. When we replace or refund a lead

Tell us within 7 days of a lead’s contact details being unlocked if:

  • the contact details are invalid: the email address bounces and the phone number (if given) isn’t in service, and you have tried both;
  • the business contact tells you they never asked to be introduced;
  • the lead is materially different from its listing, for example a different sector, or staff numbers clearly outside the listed band;
  • the business withdrew before you could reasonably make first contact; or
  • the lead was sold to you in error, for example because it had already been sold.

If we agree that one of these applies, we will offer a replacement lead of similar value if one is available, or a refund. If a business tells us it never consented, or we find we sold a lead in error, we will refund you whenever we find out, even after 7 days.

We don’t replace or refund a lead because:

  • the business decides not to go ahead, or doesn’t reply after you have made contact;
  • a buyer decides the business doesn’t qualify, or no referral reward is paid;
  • the business was already known to a buyer or registered on its own, unless we knew this when we sold the lead to you; or
  • you didn’t try to contact the business within 7 days, or you broke our lead terms.

How to ask: message us from the lead’s page in your portal, or email [to be confirmed], saying what you tried and when, with any evidence (such as a bounce message or call log). We decide each request individually and tell you the outcome within 5 working days. If we replace or refund a lead, you must stop using and delete its contact details.

This section doesn’t affect any rights you have by law.

10. How refunds are paid

  • We refund to your original payment method: card payments through Stripe, and bank transfers to the account you paid from. We aim to do this within 14 days of agreeing the refund.
  • If we refund the info pack, your access to it ends.
  • If the order was made through a referral link, the related commission is cancelled under our affiliate terms.

11. Payment disputes

If something is wrong with a payment, please contact us first so that we can put it right. If you raise a chargeback, we may suspend access to the related content or lead while it is resolved.

12. Our responsibility to you

Our website terms explain our responsibility to consumers and business customers. For leads, our total liability for any lead is limited to the price you paid for it. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude.

13. Complaints and governing law

Our complaints policy explains how to raise a concern. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you are a consumer living elsewhere in the UK, you can also bring proceedings in the courts where you live, and the mandatory consumer protections of that part of the UK still apply to you.
